Canadian Rail – August 2024 Strike Update
A strike or lockout notice could be issued on August 22nd, 2024, if Canadian rail parties are unable to reach a prompt resolution.
The Background
Following the Federal Minister of Labour’s referral to the Canada Industrial Relations Board (CIRB) in May 2024, on Friday August 9th, 2024, the CIRB has ultimately ruled that:
- A strike or lockout would not result in a serious threat to public health and safety under the Labour Code (i.e. rail services are not considered “essential”).
- No activities need to be maintained in the event of a strike or lockout at both Canadian National Railway (CN) or Canadian Pacific Kansas City (CPKC).
- They are imposing a 13-day cooling off period when no strike or lockout can take place.
The Teamsters Canada Rail Conference (TCRC), which represents close to 10 000 workers at CN and CPKC, has agreed to provide a 72-hour notice in the event of any strike action.
It is also important to note that both rail companies (CN and CPKC) issued statements that they will issue a lockout notice on August 22nd, 2024, unless there is immediate and meaningful progress at the negotiating table or a binding arbitration.
