Extension of the Surtax Remission Order on US Tariffs

Further to our previous communication, the six-month relief period under the United States Surtax Remission Order has officially been extended as of October 15, 2025. The relief measure aims to minimize the negative effects of US surtaxes on Canadian companies and entities.  

 

Background 

The United States Surtax Remission Order was initially introduced to provide relief from the payment of tariffs on US origin goods that were used in Canadian manufacturing, processing and food and beverage packaging, and for those used to support public health, health care, public safety, and national security objectives. 

The renewed Remission Order expands the scope of relief provided under the United States Surtax Remission Order (2025), first implemented in April 2025, and amended in June 2025 (current version here).

 

Remission Order Key Changes  

  • The current tariff exemption on imports of US goods that are used to support public health, health care, public safety and national security objectives under Sections 1 and 2 has been extended to December 15, 2025. 
  • The temporary exemption for US goods used in manufacturing, processing, and the packaging of food or beverage has also been extended to December 15, 2025, and now includes goods used in agricultural production. 
  • In addition to these changes, further relief from Canada’s tariffs on imports from the US and China have now been implemented for companies that met strict conditions such as demonstrating short supply or existing contractual obligations.
